Sales Agreement

All users are deemed to have read and approved this Sales Agreement upon completing the membership process.

Parties

This Agreement is entered into between Mare & Sole (“SELLER”) and the customer (“BUYER”) making a purchase through www.maresole.com.tr (“WEBSITE”), subject to the following terms and conditions.

Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale, delivery, right of withdrawal, returns, and warranty conditions of the products/services ordered electronically by the BUYER through the WEBSITE.

General Provisions

The BUYER acknowledges and agrees that they have read and accepted the essential characteristics, sales price, payment and delivery information, right of withdrawal, and return conditions of the products/services listed on the WEBSITE.

The product/service shall be delivered to the address specified by the BUYER in the order form through the courier company contracted by the SELLER.

In cases of force majeure or extraordinary circumstances preventing transportation, the SELLER may postpone delivery by informing the BUYER.

For products that are out of stock, the SELLER reserves the right to cancel the order or offer an equivalent product.

Delivery

The product subject to the order shall be delivered within a maximum of 30 days from the date the order is received by the SELLER.

The delivery period may vary depending on the BUYER's address.

If the BUYER is not present at the delivery address or refuses to accept the delivery, any additional costs incurred shall be borne by the BUYER.

Right of Withdrawal

The BUYER may exercise their right of withdrawal without providing any reason within 14 days from the date of delivery of the product.

Notifications regarding the exercise of the right of withdrawal must be submitted to the SELLER in writing or through a durable medium, such as email or a web form.

The returned product must be unused and sent complete with its original packaging and invoice.

Return shipping costs under the statutory right of withdrawal shall be borne by the SELLER.

Products and Services Excluded from the Right of Withdrawal

The right of withdrawal cannot be exercised for:

• Products prepared specifically in accordance with the BUYER's requests or personalized products
• Products that are liable to deteriorate rapidly or expire
• Hygienic products whose packaging has been opened after delivery, such as earphones, underwear, cosmetics, etc.
• Services performed instantly in an electronic environment and digital content
• Periodical publications such as newspapers and magazines
• Services provided on specific dates, such as accommodation, transportation, and car rental services

Warranty Conditions

If the product sold is defective, the BUYER may exercise the statutory rights provided under applicable law, including a refund, free repair, replacement with a non-defective product, or price reduction.

The warranty period and applicable conditions are specified in the warranty certificate provided with the product, where applicable.

If damage is detected upon delivery, the BUYER should have the damage recorded by the courier and should not accept the damaged package/product.

Defects or malfunctions resulting from improper use are excluded from the warranty coverage.

Return Conditions

Return requests may be submitted by the BUYER within the applicable withdrawal period or in cases involving defective products.

The returned product must be unused and sent together with all accessories, the invoice, and any complimentary or promotional items, if applicable.

Once the return is approved, the purchase price shall be refunded to the BUYER using the original payment method within 14 days.

For returns made outside the statutory right of return, such as returns accepted as part of a campaign or customer satisfaction policy, return shipping costs may be borne by the BUYER.

Dispute Resolution

For disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts located at the BUYER's place of residence or at the place where the Agreement is performed shall have jurisdiction, subject to the monetary thresholds determined by the Ministry of Trade and applicable legislation.

Effective Date

The BUYER shall be deemed to have accepted all provisions of this Agreement upon completing the payment approval for an order placed through the WEBSITE.
